Welcome to img-src.io ("Service"), an image hosting, transformation, and content delivery network (CDN) operated by img-src ("we," "us," "our," or "Operator"). By accessing or using our Service, you ("User" or "you") agree to be bound by these Terms of Service ("Terms" or "Agreement").

PLEASE READ THESE TERMS CAREFULLY. These Terms contain important information about your legal rights, including a binding arbitration provision and class action waiver in Section 15, which affects how disputes are resolved.

If you do not agree to these Terms, you may not access or use the Service. We reserve the right to modify these Terms at any time. Material changes will be notified via email or prominent notice on the Service at least 30 days before taking effect. Your continued use after changes become effective constitutes acceptance.

2. Description of Service

img-src.io provides a modern image hosting, transformation, and CDN service that enables users to:

• Upload and store images securely with encryption at rest
• Transform images on-the-fly via URL parameters (resize, crop, format conversion, quality adjustment)
• Deliver images globally through edge caching at CDN locations worldwide
• Access images programmatically via RESTful API
• Generate signed URLs for secure, time-limited access (Pro plan)
• Authenticate using OAuth providers (Google, GitHub, etc.)

Supported Formats: JPEG, PNG, WebP, AVIF, GIF, HEIC/HEIF, SVG, BMP, TIFF, TGA, PNM, QOI, HDR, EXR, Farbfeld, DDS, and more. Output formats include WebP, AVIF, JPEG, and PNG with automatic browser-based format selection.

API and CDN: The Service includes API access for programmatic image management and a global CDN for optimized delivery. Edge caching may result in images being stored temporarily at various geographic locations to improve performance.

3. User Accounts and Registration

To use certain features of the Service, you must register for an account. When you register, you agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials and API keys
• Promptly update your information if it changes
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

We use Clerk, a third-party authentication provider, to manage user accounts. By creating an account, you also agree to Clerk's terms of service and privacy policy.

You must be at least 13 years old (or 16 in the EEA) to use the Service. By using the Service, you represent that you meet these age requirements.

4. Acceptable Use Policy

You agree not to use the Service to upload, store, or distribute:

• Content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Content that infringes upon intellectual property rights of others
• Content that contains malware, viruses, or other harmful code
• Child sexual abuse material (CSAM) or any content exploiting minors - Zero tolerance policy with mandatory reporting
• Content promoting violence, terrorism, or hate speech
• Spam, phishing, or deceptive content
• Content that violates any applicable law or regulation

Prohibited Technical Activities:

• DDoS attacks or any attempt to overload or disrupt Service infrastructure
• Scanning, probing, or testing for system vulnerabilities
• Attempting to bypass authentication or gain unauthorized access
• Circumventing API rate limits or other technical restrictions
• Account takeover attempts (credential stuffing, brute force, session hijacking)
• Automated mass scraping without authorization
• Hosting images used in phishing campaigns or fraudulent schemes

Violations may result in immediate account suspension, content removal, and legal action without prior notice.

5. Legal Action and Enforcement

We take violations seriously and reserve the right to take legal action to protect the Service, users, and third parties.

Enforcement Actions:

• Immediate account suspension or termination without prior notice
• IP address blocking and infrastructure-level restrictions
• Content removal or access disabling
• Data preservation for legal proceedings
• Reporting to law enforcement authorities
• Information sharing with security organizations and other service providers

Mandatory Reporting: We will report to law enforcement and cooperate fully with investigations involving:

• CSAM: Reported to NCMEC (National Center for Missing & Exploited Children) and relevant authorities as required by law
• Terrorism-related content and threats
• Computer fraud and abuse (DDoS, hacking, unauthorized access)
• Copyright infringement and intellectual property violations

Civil Remedies: We reserve the right to pursue civil legal action including recovery of actual damages, attorney fees, injunctive relief, and statutory damages under applicable laws including the Computer Fraud and Abuse Act (CFAA).

Copyright (DMCA): We respond to valid DMCA takedown notices in accordance with the Digital Millennium Copyright Act. Repeat infringers will have their accounts terminated.

Evidence Preservation: We maintain logs including IP addresses, request patterns, and account activities. This information may be preserved and disclosed as required by law or to protect our legal rights.

6. Content Guidelines and Technical Limitations

The Service is subject to the following technical limitations:

• File Size: Maximum 5MB per image
• Storage: 10GB (Free), 50GB (Pro), additional at $0.05/GB
• Transformations: 1,000/month (Free), 10,000/month (Pro), additional at $0.25/1K transformations
• Upload Limits: 100 images/month (Free), unlimited (Pro)
• API Rate Limits: 100 req/min (Free), 500 req/min (Pro)
• AVIF: Maximum 8 megapixels, 4000px max dimension

Content exceeding these limits may be rejected or processed with reduced quality.

7. Intellectual Property

Your Content: You retain all rights to images you upload. By uploading, you grant us a limited, non-exclusive, worldwide license to host, process, transform, cache, reproduce, and display your content solely to provide the Service. This license terminates when you delete your content or account.

Our Service: The Service, including its design, features, and underlying technology, is protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service.

Trademarks: "img-src" and the img-src logo are trademarks. Use without prior written permission is prohibited.

8. Service Availability

We strive for high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

• Scheduled or emergency maintenance
• Infrastructure issues or third-party service outages
• Force majeure events
• Security incidents requiring immediate response

CDN and Edge Caching: Images may be cached at edge locations worldwide for performance. Cache invalidation may take up to 24 hours. We are not responsible for cached content served after the source is deleted.

Free Plan: The Free plan is provided on a best-effort basis without uptime guarantees or SLA.

9. Pricing and Payment

Free Plan: Available at no cost with limitations as described on our pricing page.

Pro Plan: $5/month billed monthly.

Payment Processing: All payments are processed by Lemon Squeezy, our Merchant of Record. By subscribing, you agree to Lemon Squeezy's Terms of Service. Lemon Squeezy handles all payment processing, billing, refunds, and sales tax/VAT collection on our behalf.

Refunds and Cancellation:

• Cancellation: Your subscription remains active until the end of the billing period. No prorated refunds for unused time.
• Billing Errors: Duplicate charges or billing errors are fully refundable.
• Refund Requests: Contact [email protected] or Lemon Squeezy support.

We reserve the right to change pricing with 30 days notice to existing subscribers.

10. Data and Privacy

Your use of the Service is governed by our Privacy Policy, which describes how we collect, use, and protect your personal information in compliance with GDPR, CCPA, and other applicable privacy laws.

By using the Service, you consent to the collection and processing of your information as described in our Privacy Policy.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT DEFECTS WILL BE CORRECTED. YOU USE THE SERVICE AT YOUR OWN RISK.

WE DISCLAIM ALL LIABILITY FOR CONTENT UPLOADED BY USERS. WE DO NOT PRE-SCREEN CONTENT AND ARE NOT RESPONSIBLE FOR USER-GENERATED CONTENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, img-src SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

SOME JURISDICTIONS DO NOT ALLOW LIMITATION OF LIABILITY FOR CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

13. Indemnification

You agree to indemnify, defend, and hold harmless img-src, its operators, officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any applicable law or regulation
• Your infringement of third-party rights
• Content you upload, store, or distribute through the Service
• Any damage caused to Service infrastructure or other users

This indemnification obligation survives termination of your account and these Terms.

14. Termination

By You: You may terminate your account at any time through account settings or by contacting [email protected].

By Us: We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or for any other reason at our sole discretion.

Account Freeze: We may freeze your account and preserve data if required by law enforcement, legal process, or ongoing investigation.

Banned Users: Users terminated for violations may be permanently banned. We may use technical measures to enforce this prohibition.

Data Retention: Upon termination, your data will be permanently deleted immediately, except where required by law or as evidence of violations (retained up to 2 years).

15. Dispute Resolution

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

Informal Resolution: Before initiating arbitration, you agree to contact us at [email protected] to attempt informal resolution for at least 30 days.

Binding Arbitration: Any dispute arising from these Terms or the Service that cannot be resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will be conducted in English. The arbitrator's decision is final and binding.

Class Action Waiver: YOU AND img-src AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate claims or preside over any class proceeding.

Exceptions: Either party may bring claims in small claims court if eligible. Either party may seek injunctive relief in court for intellectual property infringement or unauthorized access.

Opt-Out: You may opt out of arbitration by sending written notice to [email protected] within 30 days of first accepting these Terms. The notice must include your name, address, and a clear statement that you wish to opt out.

16. General Provisions

Governing Law: These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. For matters not subject to arbitration, you consent to the exclusive jurisdiction of state and federal courts located in Delaware.

Assignment: We may assign these Terms or any rights hereunder without restriction, including in connection with a merger, acquisition, corporate reorganization, or sale of assets. You may not assign these Terms without our prior written consent. Any assignment in violation is void.

Severability: If any provision is held unenforceable, the remaining provisions remain in full force. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable.

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and img-src regarding the Service, superseding any prior agreements.

No Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

Force Majeure: We are not liable for failure to perform due to causes beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, government actions, or internet/infrastructure failures.

Business Transfers: In the event of a merger, acquisition, or asset sale, your information and these Terms may be transferred to the successor entity. We will provide notice before your information becomes subject to a different privacy policy.
